These Terms & Conditions (“Terms”) govern your access to and use of MyBotGenie’s website, WhatsApp API, AI Agents, Cloud Telephony, Automation and CRM services (collectively, the “Services”), operated by MyBotGenie (“we”, “us”, “our”). By creating an account or using the Services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using our Services, registering an account, or clicking “I Agree,” you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

MyBotGenie provides a software platform enabling businesses to send WhatsApp messages via the official WhatsApp Business API, build AI chatbots and voice agents, automate workflows, and manage customer relationships through an integrated CRM.

3. Account Registration

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must be legally authorized to represent the business for which you register.

4. Subscription, Fees & Payments

• Access to paid features requires an active subscription plan as displayed on our Pricing page.
• Fees are billed in advance on a recurring basis (monthly/annual, as selected) and are non-refundable except as required by law or explicitly stated at checkout.
• We reserve the right to change pricing with reasonable prior notice.
• Failure to pay may result in suspension or termination of Services.

5. Acceptable Use Policy

You agree not to use the Services to:

• Send unsolicited bulk messages (spam), or messages violating WhatsApp/Meta’s Business Messaging Policy.
• Transmit unlawful, defamatory, obscene, or fraudulent content.
• Violate any applicable data protection, telecom, or consumer protection law (including India’s IT Act, TRAI regulations, and DPDP Act where applicable).
• Attempt to reverse-engineer, resell, or white-label the Services without a separate written agreement.

6. WhatsApp Business API Compliance

You are solely responsible for ensuring your messaging campaigns, templates, and opt-in/opt-out practices comply with Meta’s WhatsApp Business Policy. We may suspend numbers or accounts that Meta flags for policy violations, without liability to you.

7. Intellectual Property

All software, branding, and content provided as part of the Services remain the exclusive property of MyBotGenie or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes during your subscription term.

8. Third-Party Integrations

The Services may integrate with third-party platforms (e.g. Meta/WhatsApp, payment gateways, Google Sheets, Shopify, WooCommerce, Zapier). We are not responsible for the availability, accuracy, or practices of third-party services.

9. Limitation of Liability

To the maximum extent permitted by law, MyBotGenie shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities arising from your use of the Services. Our total liability for any claim shall not exceed the fees paid by you in the three (3) months preceding the claim.

10. Termination

We may suspend or terminate your account for breach of these Terms, non-payment, or misuse of the Services. You may cancel your subscription at any time through your account dashboard or by contacting support; cancellation takes effect at the end of the current billing cycle.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, and courts at Indore, Madhya Pradesh shall have exclusive jurisdiction over any disputes arising hereunder.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
